Abstract:
Acknowledgement and safeguarding human dignity is certainly one of the important points when following the law. Without it, criminal justice would be left undone. For obvious reasons, all the persons in charge must make effort to uphold the level of respect towards everyone between the people they’re dealing with everyday regardless of their social status, rank, religion, wealth, race, age and color and make sure of equality between individuals. Although social order is valuable to government and society as a whole however, keeping the society in order and other goals of people as a whole should not be used as an excuse to disregard innate rights of persons.
Thus, this research tries to in the first place, introduce human dignity and make an understanding of it and the necessity for upholding it and then, because of the importance of this issue in pretrial investigation in judiciary system where the Police is first comes in contact with the victim or suspects starting criminal case, reviews the place of acknowledging human dignity in this phase of the case. Finally, effects of upholding this element is studied. May this be a reason for all that by their inner evil, use wrong excuses to disregard human dignity and respect to stop these acts, and for a future without any violation of this principle.
